Abstract

This study explores the legal framework of limited legal capacity under the 2009 Romanian Civil Code, specifically focusing on the rights and protections afforded to minors aged 14 to 18. It details the specific categories of legal acts a minor can perform independently versus those requiring parental or judicial consent. By analyzing the regime of annullability (relative nullity), the author demonstrates how the law functions as an educational and corrective tool to restore equilibrium between a minor’s growing autonomy and the necessity of legal prudence. The research provides a comparative look at European traditions, illustrating the shift toward proportional protection that upholds human dignity while ensuring the stability of civil legal relations.
