As artificial intelligence integrates into critical sectors like healthcare and transportation, this article explores the complex legal challenge of assigning responsibility for damages caused by autonomous systems. It examines the transition from traditional fault-based liability to strict liability models, specifically analyzing the impact of the EU AI Act and the Romanian Civil Code. By investigating the “black box” phenomenon and global regulatory trends, the author addresses whether AI should be treated as a tool or an autonomous agent in the eyes of the law. Ultimately, the study advocates for a balanced legislative framework that ensures victim compensation without stifling technological innovation.
